AGU will defend Moraes in Rumble lawsuit in the USA – 06/15/2026 – Politics

The (Attorney General of the Union) announced that it will request Brazil’s intervention in the legal action being processed against the minister of the (Supreme Federal Court) — a case filed by the Trump Media group and the platform.

In a note, the body states that submitting Brazilian Justice decisions to the consideration of courts from other countries is an attempt to challenge national sovereignty and the independence of the Judiciary, in addition to meaning a “serious offense against jurisdictional immunity.”

“Acts carried out by public agents of a sovereign State cannot be submitted, without the consent of that State, to the jurisdiction of courts of a foreign State. Brazil has not consented and will not consent to the assessment of decisions of our Supreme Court by judges from another country.”

The note also says that “Brazilian judicial decisions must be complied with or questioned before our own courts, in accordance with the procedural law in force in Brazil.”

The AGU intends to file Brazil’s request for intervention this Monday (15) before the Florida federal court.

At the beginning of June, the president of the Supreme Court, , had given approval to the AGU so that the body could defend Brazil. Fachin stated that, in addition to the “individual figure of STF minister”, the “independence of the Brazilian Judiciary, the integrity of the Rule of Law in Brazil and, ultimately, national sovereignty itself” are at stake.

The judge said that he considers it “opportune and necessary for the Attorney General’s Office to take the appropriate measures to defend the Brazilian State in the context of actions filed in the United States of America.”

The lawsuits are pending in the District Court of Florida and ask that Moraes be held accountable for decisions that have been interpreted as “gag orders” and censorship against American companies and citizens.

On May 22, the US Court authorized the judge’s summons by email. According to the decision, attempts at formal notification through international cooperation between the two countries were frustrated. Once the summons has been served, there will be a 21-day period for submitting a response, under penalty of default being declared.

In recent weeks, as the Sheet showed, Fachin came to preserve the autonomy and prerogatives of the Supreme Court, in a dialogue with the AGU and the Ministry of Justice and Public Security.

The initial assessment is that a Brazilian judge cannot be personally responsible for decisions made in the exercise of his position, as the national legal system protects judicial independence.

In the case of Rumble, the process revolves around a decision made by Moraes for the platform to permanently close the account of Bolsonarist Allan dos Santos and prevent the creation of new profiles.

As the determination was not fulfilled, the minister ordered, in 2025, to suspend the video platform throughout Brazilian territory. Rumble’s lawyer, Martin De Luca, claims that Moraes acted illegally, without a legal basis.
