The publication was made on January 3, the date of Nicolás Maduro’s capture and arrest.
According to the PF, in order to characterize the crime of slander, it is necessary to falsely attribute a specific crime. In this case, the statement that Lula would be denounced would then mean the pointing out of some crime.
“The senator then lists criminal conduct that would be attributed to President Lula, including the crime of international drug trafficking, a crime for which Maduro is accused by the USA, leaving no doubt that his accusation is that President Lula had committed, among others, the crime of international drug trafficking and for this reason he would be reported by Maduro”, says the PF.
Moraes opened the investigation in April. The pre-candidate’s team for the Presidency of the Republic argued, at the time, that the procedure “evokes censorship practices and account blocking seen in the 2022 election” and said that Moraes is a “central character in the recent democratic imbalance”.
The decision led Flávio, who was coming, to repeat an accusation made by his father, (PL), in the 2022 elections and say that this year with his performance in the Supreme Court.
