PL guarantees superior rank to PMs and firefighters in case of disability

Military police officers and firefighters, when retired due to disability, may have remuneration calculated based on the rank immediately higher than the one they held, according to a project that is beginning to be processed in the Senate.

It extends to all state military personnel a right already guaranteed to members of the Armed Forces and provided for in several States. The author of the project, senator (PT-AP), gives the example of his State, where a 2014 already benefits from the remuneration of the higher hierarchical rank for active or paid reserve military personnel who are considered definitively incapable.

Randolfe adds, in justification of his project, that the ensured symmetry between the rules of the Armed Forces soldiers and those of the state military. However, the same rule only guarantees PMs and firefighters retired due to disability the remuneration for the rank they hold at the time of their transfer to inactivity. The senator seeks, in his project, to resolve this conflict.

“It is necessary and fair that state military personnel who defend society and citizens, at the risk of their lives and health, be guaranteed the right to receive salaries higher than those they received during their time on active duty, in cases where they become incapacitated precisely due to the noble role and mission they perform”he concluded.
