Bill determines rules for trade; goes to President Lula for sanction
The Senate approved on Tuesday (June 30, 2026), as a matter of urgency, the bill that allows the commercialization, acquisition and possession of aerosol plant extracts for the personal defense of women. Approved in a symbolic vote, the text also establishes rules and defines penalties for misuse of the device. Reported by the senator (PP-SE), the proposal goes to the president (PT) for sanction.
The project aims to collaborate with the protection of the physical, psychological and sexual integrity of women. According to the text, authorization is automatically granted to women over 18 years of age (or with express authorization from their guardians, from 16 years of age).
The commercial establishment must maintain a simplified record of the sale, containing the identification of the purchaser for a period of 5 years.
The use of plant extracts aerosol outside the foreseen hypotheses will subject the user to the following administrative penalties, without prejudice to applicable criminal and civil sanctions:
- formal warning, when there is no injury or concrete risk to the integrity of the person affected;
- fine of 1 to 10 minimum wages, set according to the severity of the conduct and its consequences;
- application of a double fine in case of repeat offense;
- seizure of the device and prohibition of new acquisition for a period of up to 5 years.
Anyone who uses the device outside of the prescribed terms will be criminally liable if the conduct constitutes a crime or misdemeanor.
The aerosol will be for individual use and non-transferable. The device must not contain substances with a lethal effect or permanent toxicity. And it must comply with the technical and safety standards defined in Executive Branch regulations.
The proposal also creates the National Training Program in Personal Defense and Use of Instruments with Less Offensive Potential for Women.
The implementation of the program will take place progressively, through specific regulations, which will regulate budget execution, signing of agreements and participation of partner entities.
In his report, Laércio Oliveira highlighted that the project strengthens public policies to protect women, standardizes national discipline on plant extract sprays and creates traceability and training mechanisms.
The senator also said that several units of the Federation have already approved state laws with the same purpose, such as Rio de Janeiro and Santa Catarina.
