Does it happen to you that a car is parked in front of your house and it makes it impossible for you to get home? We have several tips for you, what you can do and the best way to proceed.
Having other people’s vehicles parked in your driveway or sidewalk can be quite frustrating, especially if you are repeatedly exposed to this unpleasant situation. Fortunately, there are steps you can take to protect your right to free access to your property. How to defend yourself and what are your options?
A foreign car parked in front of the house
If you often encounter the above problem, there is no need to put up with it. There are several legal ways to defend your right to free access to your property. Try to resolve the issue out of court first, but if that doesn’t help, don’t hesitate to seek legal help. What are your rights?
Property right
As a property owner, you have the right to unhindered access to your property. If someone else’s vehicle blocks your entrance or exit, it is a violation of your property right.
Act on land transport
This law regulates road traffic rules and determines where and how it is possible to park. When your driveway is part of a public thoroughfare, municipal parking ordinances apply. So what are your solution options?
Communication with the driver
Try to negotiate with the driver of a foreign car first. Explain to him that his parking makes life very difficult for you. For example, use the warning method and place a no-parking sign in a visible location.
Contacting the city police
If the situation recurs, contact the city police and file a report. Police officers can warn the driver or impose an appropriate fine. In some cases, the city police can also tow away an illegally parked vehicle.
Civic association of unit owners
If you are a member of SVJ, contact the committee. Together you can solve the parking problem and propose, for example, reserved parking spaces for property owners.
Legal action
When the situation cannot be resolved out of court, the next solution is to file a lawsuit to protect property rights. If the parking of another vehicle has caused you some damage, you can claim compensation for the damage.
Tips for other options
Document all possible incidents with photos or videos, where the dates are indicated, or always secure witnesses. So communicate with the other owners of your property as well as the nearest neighbors. Then contact the relevant authorities or a lawyer.
What to avoid
Never damage someone else’s parked vehicle that is in your driveway or sidewalk. You would be committing a crime. Likewise, do not tow a foreign vehicle by your own means.
