The former president of PL is facing legal proceedings that could result in his trial by the First Panel of the Federal Supreme Court (). He was indicted by the Federal Police for serious crimes, including the violent abolition of the Democratic Rule of Law and criminal organization. The Attorney General’s Office (PGR) is preparing a complaint that could include another 40 people indicted in the investigation related to the coup.

The PGR is preparing to present multiple accusations to the STF, involving not only Bolsonaro, but also former ministers and other allies. The indictment by the PF indicates that there is sufficient evidence to consider Bolsonaro a likely perpetrator of the infractions, although he still maintains the presumption of innocence until the complaint is formalized and judged. The next step in the process will be the manifestation of the PGR, which must send the complaint to the minister, responsible for reporting the case to the STF.

The court’s First Panel will be in charge of analyzing the accusations and deciding whether to continue the process. In a recent decision, the STF reaffirmed that the Panels have the competence to prosecute and judge criminal actions against authorities with privileged jurisdiction, as is the case of Bolsonaro. The former president’s defense may request that the case be taken to the Court’s plenary, which could change the dynamics of the trial.

The indictment of Bolsonaro and 36 of his allies took place in November 2024. The Federal Police report points out that the former president was aware of a plan that aimed to assassinate the current president, the vice-president and minister Alexandre de Moraes in 2022. Investigations revealed substantial evidence, including messages, videos and a draft decree that suggested a coup d’état.
