Clubs and athletes begin to receive bet transfers for brand exposure

Football clubs, athletes and confederations will start receiving amounts next Friday (31) for the exposure of their brands on betting sites. This will be the first time that these parties will have compensation for the use of their names and symbols by not Brazil.

The determination that operators pay for the use of football-related brands was already in the Law that regulated the market. Last week, an ordinance determined the deadline for the first payment to be the last day of January, with a monthly recurrence.

Until , athletes, clubs and confederations did not earn anything for mentioning their symbols, images, names and nicknames on sports betting sites.

This means that when a page showed that Palmeiras and Corinthians were playing and the bet on one of them winning paid 1.5x, neither Palmeiras nor Corinthians took a share. The same goes for an athlete: even if there were bets available involving his name, he didn’t get a share of the pie.

Now, part of the value of each bet will go to those involved. The distribution works like this: after deducting prize payments to bettors, the bets they keep 88% of the revenue and another 12% are allocated to areas such as social security, education and sport.

Within the 12%, a portion of 36% goes to sports, and the majority of this amount (7.3%) is allocated to the entities that make up the National Sports System. This is where payment for image use comes from.

Operators include the number of bets placed for each club or player in the government system. So, that 7.3% is distributed proportionally to the bets received.

“This initiative will address a situation that had been very unresolved for many years, in which clubs handed over their names, symbols and athletes themselves to be used by betting sites and received absolutely nothing in return”, says the partner of CSMV Advogados office, Francisco Manssur.

Sports betting companies, however, question the deadline stipulated by the Ministry. For the legal consultant of the National Association of Games and Lotteries (ANJL), Bernardo Cavalcanti Freire, the ordinance is important as it provides for how payment should be made, but the deadline is still tight.

“It will be necessary to create structural mechanisms by January 31st. It is unfeasible for operators, in addition to imposing burdens on them. The deadline needs to be extended, this is essential. And there is a vacuum too, as competitions like the state competitions have already started”, says Freire.
