The president of the Federal Regional Court of the 5th Region, Francisco Roberto Machado, considers “pure lightness” the judge to speak of letters marked in the election to promote judges by the criterion of merit.
In clarifications to counselor Rodrigo Badaró of the CNJ (National Council of Justice), Machado says that the triple list was decided “after a fierce dispute, in which one of the candidates was only chosen in second scrutiny.”
The president countered the suspicions that the election benefited the most voted judge, Isabelle Marne Cavalcanti de Oliveira Lima, daughter of the dean of the court, Paulo Roberto de Oliveira Lima.
Machado says Nogueira tries to divert attention from the fact that the candidate “performs performance and professional qualities that fully justify her access to the Court.”
“Everyone already knew that the two best voted candidates were elected in advance,” said Nogueira.
The president of TRF-5 reaffirmed that claiming favoritism is a “appeal to ignorance.” Machado says Nogueira “disrespects good faith itself by selectively transcribing only part of the standard that disciplines the promotion by merit”, and repeat representations rejected by the CNJ and the STF.
Nogueira recalls that in 2008, the current president held in the Supreme Court “the right to run for the Judge of TRF-5 only with federal judges from the first fifth part of the seniority list.”
Complainant’s hurts
In his clarifications, Judge Isabelle says that all members on the list are over 40 years old and over 10 years of effective exercise in the position of federal judge. She is the oldest federal magistrate in the state of Alagoas.
“All members of the Triple list have already acted as federal judges summoned, in more than one opportunity, accumulating experience.”
Isabelle states that “repeat six times or more the same thesis, on different occasions, already knowing the result, reveals litigation of bad faith.”
She considered an offense to the premise that current judges and judges would press the magistrate who may be named, following her thoughts on judicial action. “
“It is insulting to assume that, just the magistrates, women, would be susceptible to pressure. This shows a prejudiced and macho view.”
Nogueira saw “discrimination within the positive discrimination of the CNJ to value the judge woman”.

Isabelle attributes the initiative of Nogueira to “hurt against the court, gathered for decades”.
“He always challenges the promotion processes by merit, placing security warrants, making complaints, seeking the press,” says the magistrate.
“There is a personal dissatisfaction for not being promoted earlier, by merit criterion, but only more recently by seniority criterion.”
Isabelle criticizes Nogueira for seeking the press (nominally cites the editor of this blog) two weeks after the formation of the triple list and made representation to the CNJ.
“Modus operandi is clearly not the one who acts imbued with the public interest and is seeking the resolution of a legal conflict,” he says.
The judge says that in promotion for merit to provide four positions arising from the increase in TRF-5 in 2022, “the same citizen used the services of the same journalist to publicly express a biased version of the process.”
Isabelle requires the filing of the procedure and expects the CNJ “to observe the reiterated conduct of the complainant (walnut), pondering if it is the case of at least warning it.”
Judge Amanda Torres de Lucena Diniz Araújo says Nogueira participated in the session in which she unanimously recognized the regularity of the administrative achievement, “without any irresignation.”
She says the judge has incurred a mistake by stating that there is no triple list “any candidate who fulfills the requirements to join the first fifth part of the seniority list.”
She informs the CNJ that she is a magistrate with over 22 years of career, and that she is part of the first fifth part of the exclusively female seniority list.
