The president of the Federal Regional Court of the 5th Region, Francisco Roberto Machado, considers “pure lightness” the judge to speak of letters marked in the election to promote judges by the criterion of merit.

In clarifications to counselor Rodrigo Badaró of the CNJ (National Council of Justice), Machado says that the triple list was decided “after a fierce dispute, in which one of the candidates was only chosen in second scrutiny.”

The president countered the suspicions that the election benefited the most voted judge, Isabelle Marne Cavalcanti de Oliveira Lima, daughter of the dean of the court, Paulo Roberto de Oliveira Lima.

Machado says Nogueira tries to divert attention from the fact that the candidate “performs performance and professional qualities that fully justify her access to the Court.”

“Everyone already knew that the two best voted candidates were elected in advance,” said Nogueira.

The president of TRF-5 reaffirmed that claiming favoritism is a “appeal to ignorance.” Machado says Nogueira “disrespects good faith itself by selectively transcribing only part of the standard that disciplines the promotion by merit”, and repeat representations rejected by the CNJ and the STF.

Nogueira recalls that in 2008, the current president held in the Supreme Court “the right to run for the Judge of TRF-5 only with federal judges from the first fifth part of the seniority list.”

She informs the CNJ that she is a magistrate with over 22 years of career, and that she is part of the first fifth part of the exclusively female seniority list.
