Moraes says that US sanctions violate sovereignty and judiciary

Minister called “illegal and unfortunate” the application of the magnitsky law against his wife, lawyer Viviane Barci de Moraes

Minister Alexandre de Moraes, from the Supreme Court (STF), classified as “Illegal and unfortunate” the decision of the US government of Lei Magnitsky Against your wife ,.

In a note released on Monday (22.Set.2025), the magistrate stated that the measure “It contrasts with the American history of respect for law and fundamental rights” e “It violates international law, the sovereignty of Brazil and the independence of the judiciary.”

Moraes stated that Brazilian judges will not accept “Covering or obstructions” in the exercise of its constitutional functions. According to him, the independence of the judiciary, the defense of national sovereignty and institutional courage are part of the Republican mission of the judiciary.

The minister also said that “Brazilian institutions are strong and solid” and that there is no room for impunity, omission or “Cowarde APAZIGUE”. Finally, he said he will continue to act on the STF “With independence and impartiality” in fulfilling the function of judging.

Moraes had already been the subject of similar measures on July 30 by the “Use of office to authorize preventive arbitrary arrests and suppress freedom of expression.”

The US Secretary of State, Marco Rubio, said on September 15 that the country would announce additional sanctions to Brazil after the former president’s (PL). The expectation, however, was that the sanctions were also directed to other ministers of the 1st class of the Supreme Court, who, by majority, ordered the former executive chief at 27 years and 3 months in prison. The only one to vote for the acquittal was Minister Luiz Fux, who presented a divergent vote.

“The illegal and unfortunate application of magnitsky law to my wife not only contrasts with the history of the United States of America, respecting the law and fundamental rights, but also violent international law, sovereignty of Brazil and the independence of the judiciary.

“Independence of the judiciary, institutional courage and defense to national sovereignty are part of the republican universe of Brazilian judges, who will not accept coercions or obstructions in the exercise of their constitutional mission sovereignly conferred by the Brazilian people.

“Brazilian institutions are strong and solid. The path is respect for the Constitution, and there is no constitutional possibility of impunity, omission or cowardly.

“As a member of the Federal Supreme Court, I will continue to fulfill my constitutional mission to judge independently and impartiality.”
