STF Plenary must maintain a number of deputies per state – 09/30/2025 – Power

The (Federal Supreme Court) must keep in plenary to block to the election of 2026 to the state, avoiding a new impasse between OEO (PT).

The trial takes place in the Virtual Plenary of the Supreme, starting this Tuesday (30) and ending on Wednesday (1st). The partial result is 2-0 for maintaining the number of 513 deputies for the next elections – with votes of the ministers and.

Three ministers heard by Sheet They claim that the climate in the supreme is by the referendum of Fux’s decision. The main argument is that Congress has shown to have acted to comply with the STF’s decision that determined the number of vacancies in accordance with population changes identified by the 2022 census.

To prevent the new distribution of chairs in Congress from reducing vacancies to some states, the House decided to adapt to the constitutional rules of popular representation.

The proposal also went through the Senate, with the house. President Lula, however, decided because the measure, unpopular, would imply increased spending.

The argument cited by Fux is that the action questioned Congress’s omission to change its composition. This omission would have been remedied when congressmen approved the bill with the reorganization of the House.

As Lula vetoed the proposal, the matter was not closed in time for the new legislation to be applied to the 2026 elections. The law provides that changes about the electoral process must be approved at least one year before the election. With the 2026 is scheduled for October 4 of next year, there will be no time to finalize the legislative process.

In his decision, Fux complied with the president of Congress and Senate, (Brazil-AP Union).

The senator filed a request for the Court to suspend the measure, given that the deadline for making this recalculation would end on Wednesday (1st).

The minister granted the request, determining the suspension of the effects of the previous decision “until the due legislative process is concluded, whose result may be applied safely and clarity, from the legislative elections of 2030”.

The change of understanding of the Supreme is still a way to abstain from a crisis between Congress and the Lula administration. Any position adopted by the Court would honor the understanding of some of the parties, displeasing the other.

the Supreme intended not to interfere with Congress’s decision on the increase in the number of federal deputies. The Court understood, in the judgment of the merits in 2023, that the definition of the quantity is made by complementary law – and therefore, it is up to Congress itself.

How would the Chamber be

If the change in the distribution of deputies began to be valid, seven states would have fewer federal deputies in the next legislature: Alagoas (1), Bahia (2), Paraíba (1), Pernambuco (1), Piauí (2), Rio de Janeiro (4) and Rio Grande do Sul (2).

Seven others would win: Amazonas (2), Ceará (1), Goiás (1), Minas Gerais (1), Mato Grosso (1), Pará (4) and Santa Catarina (4).
