Minister of the STF gives 24 hours for the lawyers of Filipe Martins and Marcelo Câmara to file the final arguments, the last step before the judgment of the criminal action
The minister of the (STF) suspended this Friday (10) his own decision that dismissed the defenses of Filipe Martins and Marcelo Câmara, former advisors to . Both are defendants in core 2 of the coup plot. Martins filed a handwritten petition with the STF to contest the dismissal and state that he does not accept being defended by the Federal Public Defender’s Office (DPU), as determined by the minister.
In the new decision, Moraes gave 24 hours for lawyers Jeffrey Chiquini and Eduardo Kuntz, who had been dismissed, to file their final arguments, the last step before the judgment of the criminal case. “I momentarily suspend the effects of the decision of 10/9/2025 and grant a period of 24 hours for the defense of Filipe Garcia Martins Pereira to make up for the absence of final arguments not filed within the legal deadline”, Moraes said. The minister also determined that the Supreme Judicial Secretariat must certify this Saturday (11) the end of the deadline for presenting allegations.

According to the minister, the defenses did not present their final arguments and had “unusual” behavior to carry out a “procrastinatory maneuver”. The deadline given by Moraes ended on Tuesday (7). “The behavior of the defendants’ defenses is absolutely unusual, including bad faith litigation, due to the admission of the intention to procrastinate the case, without any legal provision,” said Moraes.
With the decision, the minister determined that the defense of the defendants will be carried out by the DPU.

After the decision, the defenses stated that they did not miss the 15-day deadline to deliver the allegations. Jeffrey Chiquini said that the PGR added new elements to the process and, therefore, the deadline has not yet expired. The lawyer considered Moraes’ decision “arbitrary”.
Kuntz said that the allegations will be delivered by October 23, meeting the 15-day deadline. According to the lawyer, the period began to run from October 8th, the date on which a measure requested by the defense and authorized by Moraes was attached to the process.
In a statement, the Brazilian Bar Association (OAB) said it is evaluating the case. “The facts will be analyzed with serenity and responsibility. If violations of defense guarantees or the prerogatives of the professionals involved are identified, the Order will act to ensure their professional dignity, within the limits of legality and with the institutional respect that the matter requires”, declared the entity.
