Just like the minister of the (Supreme Federal Court), who left the court on Thursday (9), other ministers have already chosen to shorten their time as members of the court since redemocratization.

Of the 11 magistrates who did not complete the maximum time on the court, three retired less than a month before the deadline, and two died.

The age for compulsory retirement at the Supreme Court is 75 years old, and Barroso could remain on the court until 2033. The minister, who is 67 years old, said he would advance his departure after leaving the presidency of the Supreme Court, which happened at the end of September.

Celio Borja

He was the first minister to retire early since redemocratization. Appointed by the former president (), he took office on April 17, 1986 and left the court on March 3, 1992, bringing his departure forward by six years and three months.

Francisco Rezek

Nominated twice to the court, he took office on March 24, 1983, after being appointed by then president João Figueiredo. He resigned on March 14, 1990 to take over the Ministry of Foreign Affairs during the de Mello government (no party).

He returned to the STF on May 21, 1992, as recommended by the former president. On February 5, 1997, he advanced his retirement by 16 years and 11 months to take up a position at the International Court of Justice, in The Hague, in the Netherlands.

Nelson Jobim

Appointment of (), took office as minister of the STF on April 15, 1997. He left the position on March 29, 2006, ten years before the maximum limit, to take over the Ministry of Defense in the first term of President Lula (PT).

Sepúlveda Belongs

Sworn in on March 17, 1989, as indicated by Sarney. He retired on August 17, 2007, just over three months before his mandatory retirement.

Ellen Gracie

The first woman to join the court, she took office at the STF on December 14, 2000, recommended by Fernando Henrique. He left the court on August 8, 2011, six years and six months before his mandatory retirement.

Joaquim Barbosa

Appointed by Lula in his first term, the former minister took up his position at the STF on June 25, 2003. He left the court on July 31, 2014, shortening his time at the court by ten years and two months. If he remained in the Supreme Court, the PEC of Bengal would allow Barbosa to remain in court until 2029, when he turns 75 years old.

Less than a month

Some ministers advanced their departure by days, leaving office less than a month before their mandatory retirement. This list includes , current Minister of Justice, who retired on April 11, 2023, exactly 30 days before turning 75 years old.

In addition to him, there is also Eros Grau, who left the court 20 days before the deadline, on July 30, 2010, and , who retired on October 13, 2020, 19 days before the deadline.

Deaths

Two ministers died before reaching the maximum age. He died as a result of a plane crash in January 2017, six years and six months before his mandatory retirement, and Menezes Direito died just over three years earlier, in September 2009, due to a tumor in his pancreas.
