Possible suspension of CVM nominee has precedent in the TCU – 02/01/2026 – Panel

The request to suspend the appointment to preside over the Securities and Exchange Commission (CVM), currently under analysis at the (Federal Audit Court), has a precedent in the court itself.

In 2022, for the presidency of Anatel (National Telecommunications Agency). At the time, the argument was that Baigorri was being appointed to the position for another five years, a period that exceeded what was provided by law.

Although Lobo and Baigorri’s situations are different, precedent indicates that the TCU has the prerogative to block the process of appointing directors of federal agencies.

In the case of the CVM nominee, the request for suspension was made by the Public Prosecutor’s Office of the Court of Auditors, with the arguments that he acted in a manner and that his appointment was political, not technical.
