The Prosecutor’s Office asks Equality to block the websites of 13 surrogacy agencies | Society

The Prosecutor’s Office of the National Court has asked the Ministry of Equality to launch the administrative procedure for 13 non-EU agencies dedicated to the surrogacy or surrogacy sector. The public ministry, which points to these companies for “offering and carrying out commercial surrogacy practices” declared “illegal” in Spain, takes this step after opening an investigation into them after receiving several complaints for illicit advertising.

In its letter, the Prosecutor’s Office points to, among others, Go4Baby, which is defined on its website as a surrogacy agency with “guaranteed programs for marriages and heterosexual couples in Georgia and Ukraine and for all types of families in Colombia and Mexico.” “Your dream much closer,” he promises couples and interested people, adding: “We help you build your family with transparency and security.” Go4Baby for promoting this practice in Spain. Success is also targeted against Surrogacy, which has its headquarters in the United States and Israel; against the Americans Circle Surrogacy, Growing Generations and Invest Medical LLC; against the Georgian Betaplus Fertility; and against the Mexican Miracle Surrogacy.

The list is completed by the companies Tammuz Family, New Life Global Network, Surrogacy Beyond Borders, Surrogacy4All, Family Source Consultants and Surrogacy Network. According to the Prosecutor’s Office brief, these agencies focused their activity in countries such as the United States, Canada, Mexico, Colombia, Ukraine and Georgia. Through a resolution signed this Tuesday and addressed to the Secretary of State for Equality and for the Eradication of Violence against Women, the public ministry explains that its investigation began with several complaints filed in 2024 by the As Furias Feminist Association, which also provoked the intervention of the Ombudsman. The investigations were first focused on eight entities and, for reasons of competition, they were then distributed among several provincial prosecutor’s offices (in Barcelona, ​​Madrid and Malaga), which managed to get several.

In the letter sent to the Ministry of Equality, the Prosecutor’s Office emphasizes the need to proceed to disable access to these websites from Spain in order to comply with the national law on the defense of women’s rights. Along these lines, the public ministry recalls that, since 2023, the law considers surrogacy as a “serious form of reproductive violence” and invites measures to be taken for its “prevention” and “persecution.” Asked by this newspaper, a spokesperson for the Ministry of Equality indicated that they cannot yet evaluate the letter because they have not received it.

The Prosecutor’s Office of the National Court asks the Secretary of State to, “after processing the relevant administrative actions”, contact the companies that provide internet access services in Spain (such as Telefónica or Vodafone), so that they block access to said websites, as well as to all subdomains that may lead to “illegal” content. Likewise, in the event that Equality considers that this action may affect data protected by the rights and freedoms of expression and information, the Prosecutor’s Office urges that the “mandatory judicial resolution” be requested to be able to execute it.
