Tax Authority says Joana Vasconcelos owes €590,000 in back taxes: artist goes to court

Visual artist Joana Vasconcelos returned to court to contest the charge of 590 thousand euros in back taxes required by the Tax Authority (AT), in a process that has been going on for several years and which originates from a tax inspection of her company’s accounts.

According to the newspaper Correio da Manhã, the creator filed a new appeal at the Centro Sul Administrative Court with the aim of blocking the collection of that amount, after previous decisions were unfavorable to her.

A process that has been ongoing since 2022

The case dates back to a tax inspection of the accounts of the company União Infinita, Projetos Lda, for the years 2014 and 2015. According to the same source, the legal process has been ongoing since 2022, following the conclusions of this tax action. AT understood that there was a missing tax, at a time when the artist declared IRS payments worth 1.5 million euros.

After disagreeing with the Tax Authority’s conclusions, Joana Vasconcelos appealed to the Administrative and Tax Arbitration Center, which analyzed the company’s tax framework. The publication adds that that entity considered the tax transparency regime applicable. The arbitration center recognized that there was tax due, setting the amount at 590,000 euros.

Evolution of the company over the years

The company União Infinita, Projetos Lda was created in 2006 with a share capital of 5,000 euros. According to the same source, in 2009 it became a limited liability company, when Joana Vasconcelos ceded a fifth of the company to her then husband, Duarte Cordeiro.

In 2014, the share capital was increased to 50,000 euros. In 2018, Duarte Cordeiro was removed from office, a circumstance that, according to , caught the AT’s attention when analyzing the accounts.

New business structures and foundation

Meanwhile, in 2019, a second society was created, União Infinita Projetos 2. According to the same source, the artist also formed a foundation dedicated to her work. According to the same newspaper, this foundation has total assets of more than 1.1 million euros and liabilities of 24,365 thousand euros. The share capital of the first company was subsequently increased by 353 thousand euros.

The new appeal presented at the Centro Sul Administrative Court aims to change the arbitration decision that confirmed the existence of missing tax. It is this decision that Joana Vasconcelos wants to change, writes the publication about the judicial initiative now underway.

The final decision will be up to the court, in a process that involves the interpretation of the tax framework of the artist’s activity and which keeps the payment of the 590 thousand euros claimed by AT under discussion.
