The president of the TJ-SP (Court of Justice of São Paulo), said in a message to colleagues that he traveled to Brasília to “protect the interests of the category” and that the ministers of the (Supreme Federal Court) recognize the gap in the salary paid to judges.

On Monday (23), the minister determined that compensation should be paid to members of the Judiciary and when expressly provided for in law approved by the National Congress.

In the message, sent via WhatsApp to São Paulo magistrates, Loureiro also says that he has been to seven Supreme Court ministers’ offices over the last two weeks and intends to have a new round of conversations this Tuesday (24). Through a note, the TJ-SP informed that Loureiro went to Brasília to contribute to the discussions of a consensual proposal for remuneration policy for the category.

The TJ-SP is against a decision by minister Flávio Dino, of February 5, which barred the payment of penduricalhos beyond the country’s public service ceiling. In the appeal, Loureiro states that the “generalized suspension” of compensation funds “can generate federative asymmetry, irremediably compromise the administration of Justice, produce irreversible financial effects and create systemic legal uncertainty.”

In the message sent to his colleagues, the president of the São Paulo court called Gilmar’s decision a “new fact” and said that, throughout his visits to the ministers’ offices, he got the impression that there were two consensuses.

One would be about the “need for uniformity and clarity in the rules on compensation amounts paid by the courts and the establishment of a total limit on payments.” The other, “the recognition of the gap in the subsidy [salário] due to the non-replacement of inflation over the last 20 years”.

In São Paulo, a judge earns between R$35,800 a month and R$41,800, depending on the stage of their career. With penduricalhos, in 2025, the average salary exceeded R$ 100 thousand per month, according to a survey carried out by Sheet based on data from the TJ-SP transparency portal.

In addition to speaking about his impressions after meetings with ministers, Loureiro said that “a consensual proposal will be created in the coming months to establish provisional objective rules, until the approval of an ordinary law” that regulates payments to the category.

The trial of the action in which Dino’s decision was handed down will take place this Wednesday in the court’s plenary.

In the message, Loureiro says, based on conversations with ministers, that the judgment “should establish the general guidelines for the provisional remuneration and compensation regime, the implementation of which will be detailed in the coming months.”

The president of the São Paulo court concluded his statement by promising that “all efforts will be made to protect the interests of the judiciary”.

The judge’s position is in line with positions he had previously expressed. In addition to the appeal filed against Dino’s decision, which limited payments, Loureiro said, in an interview with Sheetat the beginning of the month, shortly after taking office, until then.

“Payments, compensations are maintained, as well as subsidies. There will be no change in salary policy”, stated the judge, at the time. “I don’t use the term penduricalho. We have subsidies. The subsidy is what we receive within the Supreme Court ceiling. And we have, like any worker, funds to receive relating to past periods, which are paid in installments.”

In a note sent to the report, the TJ-SP stated that the president of the court went to Brasília “to contribute to the effort of mutual cooperation, in search of a consensual proposal for a remuneration policy to establish objective and provisional rules, until the approval of the ordinary law.”
