Gonet criticizes Dino’s decision on pendants

The Attorney General of the Republic (PGR), Paulo Gonet, criticized the decision of minister Flávio Dino which determined the review of “hangings” paid to all public servants of the Three Powers based on a complaint that, in its origins, was restricted to attorneys from Praia Grande (SP).

“The preliminary decision deals with a topic that is unrelated to the object of the case, and that was not necessary for the judgment of the complaint itself”, stated in oral argument in the preliminary injunction trial at the Federal Supreme Court (STF).

The session was suspended and the discussion will resume tomorrow with the votes of the ministers. Gonet highlighted that respecting the action’s request is important to limit the Judiciary’s actions and that changing the object of the request offends the principle of separation of powers.

“The linking of jurisdiction to the request is a formula for limiting Judiciary power, it is a crucial aspect of the system of checks and balances”, he highlighted.

“The question that arises in this case has the most impactful repercussion for the constitutional system itself. The precedent that can be formed here has the potential to substantially affect the limits hitherto imposed on the Court’s power to act”, he added.

Gonet highlighted that the topic discussed in the action is of “pressing importance” and that the criticism is about the way the problem is discussed.
