O minister Alexandre de Moraes asked for a view and suspended this Tuesday (10) the trial at the Federal Supreme Court (STF) of Globo’s lawsuit against TV Gazeta de Alagoas. The company is owned by the family of former president Fernando Collor.
A action began to be judged last weeka, in a virtual plenary, on Friday. The case rapporteur is Edson Fachin, who voted in favor of Globo. He argued that “the judicial imposition of maintaining the link prevents the delegatee from exercising the duty of ensuring the integrity of its programming and the institutional reputation associated with its brand”.
He also wrote in his vote that “the integrity of the public broadcasting service cannot be conditioned by the private interests of a company in crisis”, citing the words of Minister Luís Roberto Barroso, president of the STF at the time when TV Gazeta lost the right to retransmit the signal from the Rio station, by his decision. Ministers Flávio Dino and Cristiano Zanin followed the rapporteur.
Remember the case
As broadcasters have been in dispute since September 2025. O Globo’s signal was retransmitted by the TV that belonged to Collorbut it was redistributed to another affiliate after Barroso’s decision. The company is now in the hands of Collor’s wife.
There was a five-year mandatory membership renewal maintenance contract, imposed by the Superior Court of Justice, which Fachin judged was not “a constitutionally legitimate means of preserving the company”, which is in judicial recovery.
