The Chamber of Deputies approved this Tuesday (10) a bill that obliges the police authority to request the Court to use for suspects of violence against women when there is a risk of aggression. The proposal still needs to be analyzed by the Senate.
The text establishes that, when identifying a dangerous situation, the police must immediately request electronic monitoring of the aggressor. The analysis of the measure will be the responsibility of the judge responsible for the case, who will have up to 24 hours to decide whether to maintain or revoke the determination.
If the court decision is against the application of the ankle bracelet, the judge must provide justification for the refusal.
The proposal also foresees the creation of a security system for the victim to monitor, using an electronic device, the approach of the aggressor. Whenever the distance limit defined by the Court is breached, an automatic alert must be sent simultaneously to the victim and the nearest police unit.
According to the project report, electronic surveillance tends to reduce the recurrence of attacks, as it increases control over compliance with judicial measures and discourages new violent conduct.
The text also establishes an increase in the penalty when there is non-compliance with the restricted areas determined by the Court or in cases of removal, violation or alteration of monitoring equipment without judicial authorization.
