Master Case: MPTCU argues that CAE can overturn audit secrecy at BC

O MPTCU (Public Prosecutor’s Office at the Federal Court of Auditors) argued that the CAE (Economic Affairs Commission) of the Senate can overturn the secrecy of the audit in the BC (Banco Central) about the case of Banco Masterin response to the letter from the senator Renan Calheiros (MDB-AL).

Last week, the TCU authorized the sending of documents and information obtained during the BC inspection to the CAE, but indicated that confidentiality would be maintained. The letter from Senator Renan Calheiros, president of the Commission, requests that parliamentarians be able to decide on this issue.

In the response, the deputy attorney general of the MPTCU, Lucas Rocha Furtado, says that the TCU, as an auxiliary body of Congress, cannot impose the secrecy regime on the CAE. “It cannot be substituted for the decision-making sphere of the Senate itself regarding the way in which this information is processed”, he points out.

“The final word, regarding the regime of publicity or confidentiality of information within the scope of the Federal Senate, belongs to the CAE itself, in light of its constitutional and regulatory prerogatives”, he adds.

HAS CNNFurtado stated that CAE can now decide on secrecy. “Whether it’s black or white for the TCU, this rule doesn’t apply to the Senate, he said.

At the beginning of the year, the TCU took a leading role in the developments in the Master case. The rapporteur even ordered an inspection at the BC (Central Bank) to gather information about the monetary authority’s decision to liquidate Daniel Vorcaro’s institution.
