The Bill prohibits the granting, renewal and maintenance of carrying or possessing a firearm for people with a history of violence against women, children or adolescents. The proposal is under analysis in the Chamber of Deputies.
According to the text, the restriction applies to individuals convicted by court decision final and unappealable (when there is no further appeal) and also to those who are the target of urgent protective measures in force based on .
Children and teenagers
The proposal specifies that the prohibition also affects those who have been convicted of crimes committed against children or adolescents, under the terms of the Child and Adolescent Statute (ECA – Law 8,069/90).
Furthermore, the prohibition extends to those who face criminal action for these crimes (both against women and against minors), as long as there is sufficient evidence of authorship and materiality recognized in court.
Prohibitions
In addition to preventing the possession of the weapon itself, the project prohibits these individuals from accessing any environment or activity related to shooting. The following are prohibited:
- membership and attendance at clubs, schools or shooting ranges;
- participation in sports or recreational shooting activities;
- obtaining a hunting license.
Shooting and hunting clubs must implement mechanisms for consulting official databases to prevent these people from entering. Non-compliance can lead to a fine, suspension of operation and even revocation of the establishment’s registration.
Justification
In justifying the proposal, the deputy (Avante-BA) warns that the presence of firearms in the domestic environment increases the risk of family tragedies. He cites studies indicating that the likelihood of femicide increases by up to five times when there is a weapon available in the home.
“This project strengthens protection for victims, preventing violent individuals from having access to weapons or shooting environments”said the deputy.
He bases his argument on the 2024 Yearbook of the Brazilian Public Security Forum, which recorded a femicide every 6 hours in the country, in addition to high rates of violence against children. For the author, the ban is necessary to close gaps in the law that currently allow aggressors to maintain contact with weapons through sporting or hunting activities.
Next steps
The proposal will be analyzed in conclusive character by the Public Security and Combating Organized Crime committees; and Constitution and Justice and Citizenship. To become law, the proposal must be approved by the Chamber and the Senate.
