Moraes votes against extending the INSS CPMI; score is 3 to 1

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), voted this Thursday (26) to overturn the decision of Minister André Mendonça that determined the extension of the work of the INSS Joint Parliamentary Commission of Inquiry (CPMI).

With the minister’s vote, the voting score is 3 votes to 1 against the extension. In addition to Moraes, minister Flávio Dino and Cristiano Zanin also spoke out against the extension. Only Mendonça validated the extension for a period of up to 60 days.

Moraes highlighted the importance of investigations by the CPIs and to determine the responsibility of those who defrauded the National Social Security Institute (INSS).

However, the minister said that there is no “clear and certain right” to force the extension of work.

“The establishment, with a specific deadline, and a determined fact, is a right of the minority [oposição]. Extension is a majority right. Anyone who studies parliamentary commissions of inquiry knows”, he explained.

The minister also cited “abuses” and accused the commission of leaking confidential information to the press.

“CPMI made a link with confidential data from all Federal Police evidence of contacts, calendars, phone calls and distributed it to journalists.”

Conversation

Earlier this month, Alexandre de Moraes denied having had conversations with banker Daniel Vorcaro on November 17 last year, when the businessman was arrested for the first time after being the target of Operation Compliance Zero, which investigates fraud at Banco Master.

The alleged exchange of messages was published by the newspaper O Globo, which had access to prints of messages found by the Federal Police (PF) on Vorcaro’s cell phone, which was seized during the operation.

The conversations are confidential and began to be publicized by the press after being sent to CPMI.

Extension

Last Monday (23), Mendonça, who is the case’s rapporteur, gave 48 hours for the president of the Senate, Davi Alcolumbre (União – AP), to read the request to extend the CPMI’s work.

The minister responded to the request for an injunction made by the president of the commission, senator Carlos Viana (Podemos-MG). According to the senator, Alcolumbre and the Board of Directors failed to receive the extension request.

Earlier, given Alcolumbre’s inaction, Viana decided to extend the CPMI for up to 120 days and suspended the session until the end of the trial session to await the STF’s final word.
