“The career is no longer interesting, people are going to seek the private sector and go to big offices. The tendency is to strengthen those who are against social interests, the side of criminals, of offenders”, he states.

The Supreme Court’s decision placed a limit on the so-called penduricalhos paid to the judiciary and to prosecutors, with some implications for other legal careers such as public lawyers.

She defined that extra payments, created to compensate for specific expenses incurred in carrying out the role, may exceed the constitutional ceiling (R$46,366.19) by up to 70% of the limit value.

Other benefits, such as housing assistance, food assistance and compensatory leaves, are now vetoed.

The representative of the Minas Gerais Public Prosecutor’s Office recognizes that there are excesses in the remuneration of certain members of the judiciary and the Public Ministry, but says that this is not the case of the Minas Gerais body.

“It’s one thing for you to cut the hype, bring it to the ditch. They [ministros do STF] They took the exception and treated it as if it were the rule”, says Jabour.

The prosecutor states that the Public Ministry of Minas will fully comply with the STF’s decision and that, in those of ministers Flávio Dino and Gilmar Mendes, the body did not need to make major changes to the payroll.

One of the trinkets that Minas Gerais prosecutors and prosecutors will no longer receive will be health aid.

As last year, a law sanctioned by Governor Mateus Simões (PSD) authorized the payment of benefits to members of the Public Ministry corresponding to 10% of the monthly subsidy.

Now, attorneys and prosecutors will need to submit medical expenses for reimbursement.

The Minas Gerais prosecutor states that there will be no decision by the Supreme Court in the body.

“We can’t stop. There are a lot of people who depend on our actions and we are aware of that.”
