The approved, this Tuesday (31), a bill that establishes rules for the shared custody of pets in cases of separation. The proposal now goes to the president for approval.
The text allows dogs, cats and other pets to share their coexistence between their owners after the end of the relationship. Furthermore, the measure also provides how the division should be made when there is no agreement between the parties.
Authored by the deputy Laura Carneiro and with a report from Senator Venetian Vital do Rêgothe project maintains the legal status of the animal as property, but recognizes the emotional bond between the pet and its guardians.
If there is no consensus, it will be up to the Court to define how coexistence and the division of expenses will be. For this, the animal may be considered common property, living with both guardians.

In making the decision, the judge must take into account factors such as the environment offered to the animal, daily care, the ability to support itself and the available time of each owner.
The project also determines that basic expenses, such as food and hygiene, are the responsibility of whoever has the pet during the period. Costs for veterinary consultations, hospitalizations and medications must be divided between the parties.
The proposal prohibits shared custody in cases of domestic violence or a history of mistreatment. In these situations, ownership of the animal will be transferred to the other party, with no right to compensation for anyone who loses custody.
