O Federal Senate approved on Tuesday (31) a Bill (PL) that provides for the shared pet custody in case of separation of the guardian couple. The proposal goes to President Lula (PT) for approval.
The measure applies to pets that have become most of their lives with the couple. If the marriage or stable union ends, custody and expenses for the animal must be divided in a balanced way.
Guardians can go to court to guarantee shared custody. The period of coexistence with the pet will be divided according to the financial conditionsof housingof Carefulin addition to the time availability.
Food, hygiene and care expenses, such as veterinary consultations and medicines, will be divided equally between tutors.
If one of the guardians renounces shared custody, he or she will lose possession of the animal, without the right to compensation. He will have to pay the pet’s expenses until the date of resignation.
The guardian may lose custody permanently and without compensation if he repeatedly and without justification fails to comply with the terms of custody.
The judge may deny joint custody if he identifies abuse of the animal, or a history or risk of domestic violence. In this case, the attacker loses possession of the pet.
