SP court ordered compensation of R$12,000 after deputy made derogatory comment about influencer’s photo
In the first instance, the federal deputy (PL-MG) was sentenced to pay R$12,000 for moral damages to the influencer and dancer. She commented on the decision on social media on Wednesday (1st April 2026).
The process was motivated by a (formerly Twitter). At the time, Thais Carla had shared a photo with her body painted like that of the character Globeleza. Nikolas Ferreira republished the image with the phrase “They took away the beauty, and all that was left was Globo”.
Speaking, the influencer stated that the episode was not a simple joke. “I sued a federal deputy, a public figure, after he expressed hatred and fatphobia against me”he said. According to her, the case is not about opinion, but about violence.
Details of the court decision
The decision was handed down by judge Fabio Pando de Matos, from the 1st Court of the Special Civil Court of the Court of Justice of São Paulo. The sentence prohibits the deputy from making new publications with the influencer’s image or name accompanied by derogatory comments, under penalty of a fine of R$4,000.
Commenting on the decision, Thais Carla said that the Court recognized that the use of images for derogatory content about the body harms honor and dignity. “Freedom of expression is not a free pass for prejudice or violence”he stated.
Message against prejudice
For the dancer, the decision goes beyond the individual case and serves as support for other victims. “This victory is for all the fat people who suffer attacks every day”these.
Thais Carla also stated that the dehumanization of fat bodies should not be tolerated. “Gordophobia is violence and generates accountability”he declared.
Reaction
After the sentence was announced, the deputy spoke out on social media. In a publication on Tuesday (March 30, 2026), he criticized the decision of the São Paulo Court and stated that “Brazil is a joke”.
This Thursday (April 2), the deputy used his profile to republish a post accusing Thais Carla of having made derogatory comments about model Gisele Bündchen’s body in the past. The post contains supposed quotes from the influencer – like “Gisele Bündchen is a piece of shit”, “it looks like a piece of paper” e “if it turns, you don’t know if it’s sideways or forwards”– and mocked the legal action: “This is Thaís Carla who is suing Nikolas for ‘talking’ about her body”.

The sentence handed down this week determines the payment of R$12,000 for moral damages and establishes a fine of R$4,000 if the deputy fails to comply with the order and republishes the name or image of the influencer linked to offenses.
Despite the victory in the compensation claim, judge Fabio Pando de Matos rejected Thais Carla’s defense request that Nikolas be forced to make a public retraction. In the judge’s assessment, financial compensation and abstention from new offenses already repair the “essential core of moral damage” suffered by the dancer. Furthermore, the judge justified that forcing someone to apologize is not morally effective and is not an appropriate measure in current jurisprudence.
