President of the STF says that mention of Moraes, Toffoli and Gilmar Mendes is inappropriate; Ministers mentioned speak of “pamphleteer” use of investigation
The president of the Federal Supreme Court (STF), Luiz Edson Fachin, repudiated this Tuesday (April 14, 2026) Alexandre de Moraes, Dias Toffoli and Gilmar Mendes in the senator’s report (MDB-SE) on the Organized Crime CPI. In a note, Fachin says that the inclusion of ministers is undue and speaks of “deviation from purpose”.
For the president of the Court, the Senate committees must act with responsibility and relevance. “Deviations from the thematic purpose of these Commissions, however, weaken the democratic pillars and threaten the fundamental rights of any citizen”.
Fachin says he sympathizes with the colleagues mentioned in the report and declared that “It is up to everyone to respect the independence and autonomy of the Powers of the Republic, as is the centuries-old tradition of our institutions”.
“The Presidency of the Federal Supreme Court emphatically repudiates the undue inclusion and alleged involvement of Ministers Alexandre de Moraes, Dias Toffoli and Gilmar Mendes, unduly mentioned in the report of the Parliamentary Commission of Inquiry into Organized Crime, in the Federal Senate”he stated. Gilmar and Toffoli react
During the session of the 2nd Panel of the STF, this Tuesday, Gilmar Mendes and Dias Toffoli criticized the document, stating that the document constitutes an abuse of power and could lead to politicians being held accountable. André Mendonça and Luiz Fux expressed solidarity with the ministers.
President of the 2nd Panel, Gilmar Mendes started the session and argued that the Supreme Court plenary should analyze the scope of the CPI investigations. “I love being challenged, I have fun with it, but others kneel and are afraid. We need to be careful”he stated.
For Gilmar Mendes, congressmen make selective leaks of tax information with the aim of gaining votes. In his speech, the minister stated that both the Organized Crime CPI and the INSS used their investigative tools for electoral and “pamphleteers”.
Also cited in the final report, Dias Toffoli stated that the document has no factual basis and has the “aim to win votes”. For Toffoli, there is an abuse of power in the actions of congressmen. “We cannot fail to electorally disenfranchise those who attacked institutions to win votes”.
The minister classified the document as “adventurous report” and stated that the senators who work in the CPI do not have the “dignity to be eligible”. Toffoli argued that the Electoral Court should challenge the candidacies of congressmen who work in the CPIs for purely electoral purposes.
The ministers received the solidarity of Luiz Fux and André Mendonça, who stated that it was necessary to respect investigation procedures without leaking information. Fux agreed with Gilmar and highlighted that the commissions’ investigative powers need to be reviewed.
