This Wednesday (15) approved the urgent processing of a bill that provides amnesty for traffic violations committed by drivers of vehicles used in humanitarian aid after the floods in Rio Grande do Sul. The proposal, however, includes a tortoise: truck drivers who participated in demonstrations and blockades in 2022 will also be amnestied.
The text will grant amnesty “to cargo transporters, individuals and legal entities and to drivers who have been penalized, administratively, civilly or criminally” as a result of demonstrations, blockades and related acts in 2022.
The proposal specifies that the amnesty covers fines imposed by judicial or administrative decisions, civil and administrative sanctions, ongoing judicial and administrative proceedings, which must be extinguished, and convictions that have already become final and unappealable, the effects of which are suspended.
Fines will also be cancelled, including those already included in active debt, as well as ongoing collections suspended.
Urgent processing speeds up the vote on a project, as it allows it to be assessed directly by the plenary of the Chamber of Deputies, instead of going through committees.
In Rio Grande do Sul, the project provides amnesty for infractions committed during the period of public calamity related to climate events. The text cancels fines, including those already included in active debt, and suspends ongoing administrative and judicial charges, as long as it is proven that the vehicle was used in humanitarian aid at the time of the infraction.
The tortoise was included during the text’s processing at the Road and Transport Committee, which approved the proposal this Wednesday. It would still be assessed by the CCJ (Constitution, Justice and Citizenship Commission).
According to the commission’s rapporteur of the text, Afonso Hamm (PP-RS), “the measure seeks to promote legal and social pacification, notably given the incidence of high fines, ongoing executions and serious administrative consequences for transport workers”.
The amnesty for protesters led the PT, the PCdoB and the PCdoB to speak against the matter, despite claiming to be in favor of the amnesty linked to drivers in Rio Grande do Sul.
“We have a concern: the last approved replacement for this project ends up giving amnesty to those who participated in protests in 2022, including preventing voters from reaching the polls, etc., and in our opinion this is a complicated element”, stated the leader of Psol, Tarcísio Motta (Psol-RJ).
“Regarding the floods in Rio Grande do Sul, we all sympathize and support, but when it refers to another historic act that is linked to the Democratic Rule of Law, to the disruption of democracy, we do not agree”, said PT leader, Pedro Uczai (PT-RS).
Chamber President Hugo Motta (Republicanos-PB) stated that “the merits of the matter will be widely discussed before being voted on”.
