The São Paulo Court accepted this Wednesday (15) the request for interdiction of the former president (), 94, made by three children — Paulo Henrique, Luciana and Beatriz. The reason is the worsening of the disease at an advanced stage.
With the decision, Paulo Henrique Cardoso becomes his father’s provisional curator. It will be up to him to answer for civil acts and the financial and patrimonial life of the former president. The information was published by the columnist, and confirmed by Sheet.
The family and the FHC Foundation state that they will not comment on the matter, which is “strictly of an intimate nature”.
The petition was signed by lawyers Caetano Berenguer, Fabiano Robalinho and Henrique Avila, from the firm Bermudes Advogados. The request was accompanied by a medical report certifying the condition of .
The request states that, given his worsening Alzheimer’s, the former president became “incapable of performing the acts of civil life.”
“Fernando Henrique Cardoso’s current delicate health condition, and the confirmation that the authors have always been responsible for his father’s care, is also attested by the written testimonies presented by people who have been in close contact with the Cardoso family for decades,” the document says.
The petition was filed on Tuesday (14) at the 2nd Family and Succession Court of the Central Civil Court of São Paulo and granted the following day by judge Ana Lúcia Xavier Goldman. The process is carried out in secrecy.
In the decision, the judge justifies the appointment of Paulo Henrique by the “signs of trust placed by the defendant in the person now appointed, appearing as his attorney”.
The health situation would compromise the validity of the powers of attorney previously granted by FHC to the children, which motivated the request for interdiction. The document also contains communications between family members and the former president’s care team, such as for the purchase of medical care materials, and attaches existing powers of attorney.
The judicial measure is provisionally valid for acts of asset management, following the authors’ request. Other acts will only be included after medical expertise provided by law.
Fernando Henrique governed the country from 1995 to 2002. After leaving the Presidency, he no longer held public office, but remained active in the political debate, within the PSDB or through his foundation.
More recently, his most prominent public appearance occurred in 2022, when (PT) in the presidential contest against (PL). A video with the statement was used in the PT’s electoral program at the time.
