Carmén Lúcia votes to convict Eduardo Bolsonaro of defamation against Tábata Amaral

The minister followed the vote of rapporteur Alexandre de Moraes in an action filed with the STF; the votes of eight ministers still remain

The minister of the Federal Supreme Court (STF) Cármen Lúcia followed the vote of minister Alexandre de Moraes and voted this Monday (20) for the conviction of former federal deputy Eduardo Bolsonaro (PL – SP) for defamation against deputy Tábata Amaral (PSB – SP).

Moraes, who is the rapporteur of the criminal action, had already voted on Friday (17) to convict the former federal deputy. The case is under trial and the minister understood that the son of former president Jair Bolsonaro should be sentenced to one year in open prison. The case is judged by the virtual plenary of the Supreme Court.

The lawsuit was filed against Eduardo Bolsonaro after a post on social media.

In 2021, he wrote that the bill proposed by the parliamentarian to guarantee the free distribution of tampons to the population would have the objective of serve the business interests of “his mentor-sponsor Jorge Paulo Lemann”, shareholder of a company that manufactures personal hygiene products.

By voting for conviction, Moraes understood that defamation against the deputy had been constituted. “The disclosure made by the defendant reveals the means of ruse he employed, whose objective was solely to achieve the honor of the author, both in the public sphere, as a political agent, and in her private life, since the reach provided by the Internet, as is known, is gigantic and has enormous power of proliferation”, he stated.

Electronic voting will be Open until April 28th. The votes of eight ministers are missing.

During the process, Eduardo Bolsonaro’s defense said that the statements were made within the scope of parliamentary immunity.

The former deputy has been in the United States since last year and lost his mandate due to his absence from sessions of the Chamber of Deputies.

Eduardo Bolsonaro’s reaction

On social media, Eduardo Bolsonaro criticized Alexandre de Moraes for being the rapporteur of the case and a “close friend” of Tábata Amaral, who opened the complaint against the former deputy. In the publication made this Monday he shared a photo from the deputy’s wedding in which Moraes appears as one of the guests at the ceremony.

“In the same image: the author of the case against me (Tabata) and the “judge” (Moraes) who sentenced me to 1 year in prison + fine, all at her wedding! This is what Brazil has become with the Lula-Moraes association. Have you ever imagined being sentenced by a judge who is a friend of the one who is prosecuting you?”, wrote Eduardo.
