Messiah rejected by the STF: what happens now?

With 42 votes against, the Senate Plenary rejected, in an unprecedented move, the nomination of the Union’s attorney general

New nominee will go through the same rite as Jorge Messias

The Federal Senate this Wednesday (29) nomination by the Union’s attorney general, Jorge Messias, to the Federal Supreme Court (STF) by 42 votes against and 34 in favor. With the decision, President Luiz Inácio Lula da Silva (PT) will have to appoint a new name to fill the vacancy left by former minister Luis Roberto Barroso.

After Lula chose a new name, the nominee will have to go through the same rite to which Messiah was subjected. The first action starts from Planalto, which has to send a nomination message to the Senate.

From communication, a rapporteur for Senate procedure. The parliamentarian is also responsible for prepare a report on the nominee and present the document to the Constitution and Justice Commission (CCJ). Afterwards, the board conducts a hearing.

After the CCJ procedure was won, it is up to the Plenary to decide whether to approve or reject the nomination. To go to the STF, the nominee must receive support of the absolute majority of the Senate. In other words, the approval of at least 41 senators.

If Lula’s new nominee is approvedthe Senate communicates the decision to the Executive for publication of the appointment in the Official Gazette of the Union.
