Asfav (Association of Relatives and Victims of January 8th), a group that brings together family members of the January 8th coup plotters, states that around 600 people will benefit from the so-called dosimetry bill, after the overthrow of .
The entity states that, as most of the cases are processed under secrecy in the STF (Supreme Federal Court), it is only possible to have estimates. According to the group, around 150 convicts are imprisoned in a closed regime — such as the former Minister of Defense.
Approximately another 70 people are serving their sentences at home by decision of Minister Alexandre de Moraes, like the former president (PL). A larger contingent, of around 380 convicts, is currently complying with precautionary measures, such as the use of electronic ankle bracelets.
The association states that lawyers are awaiting the publication of the law to request a review of Moraes’ punishments.
Petitions must be presented individually, since the sentences applied were different (generally 12, 14 or 17 years in prison) and there are initiatives that count points towards reduction, such as reading books or working.
“These people who are in prison, especially those who have been there since the 8th [de janeiro de 2023]they have already served their sentences and will be able to return home. This brings encouragement to families, but it does not bring back dignity and justice”, says the association’s lawyer, Carolina Siebra.
the dosimetry PL says that the penalties for the crimes of coup d’état and violent abolition of the democratic rule of law should not be applied cumulatively when inserted in the same context. It will be worth the most serious penalty or, if equal, one of them, increased by one-sixth to half.
The text also provides for a penalty reduction of one to two thirds for the crimes of attempted coup or abolition when they have been committed in a crowd, as long as the agent has not carried out an act of financing or exercised a leadership role.
Furthermore, the project allows those convicted of the 8th of January to have regime progression after one-sixth of the sentence served. Under the previous rules, progression would come after a quarter of the sentence served.
