‘Débora do Batom’ wants lesser sentence after dosimetry PL – 05/02/2026 – Brasília Hoje

The defense of , known as “Débora do Batom”, informed that she will ask the (Federal Supreme Court) for a reduction in sentence after the National Congress overturned the presidential veto of the dosimetry bill, which reduces the penalty for those convicted of . The lawyers will also file a request for an injunction for her freedom.

The hairdresser participated in the attacks on January 8 and became known for spraying lipstick on a statue in front of the Supreme Court, with the phrase “you lost, idiot”. She was sentenced to 14 years in prison for the crimes of attempted violent abolition of , coup d’état, damage to listed property, qualified damage with violence and armed criminal association.

Débora since last year. Her lawyers will also ask for her freedom based on the veto being overturned.

The request for sentence reduction will be presented more effectively after the enactment of the law, according to the defense,

“An injunction request was made so that the prisoner’s freedom could be immediately restored, avoiding the perpetuation of an undue restriction that is incompatible with the current legal-legislative understanding”, states a note signed by lawyers Hélio Garcia Ortiz Junior and Tanieli Telles de Camargo Padoan.

The text says that the penalties for the crimes of coup d’état and violent abolition of the democratic rule of law should not be applied cumulatively when inserted in the same context. It will be worth the most serious penalty or, if equal, one of them, increased by one-sixth to half.

The project also provides for a penalty reduction of one to two thirds for the crimes of attempted coup or abolition when they have been committed in a crowd, as long as the agent has not carried out an act of financing or exercised a leadership role.

Furthermore, the text allows those convicted of January 8th to have regime progression after one-sixth of the sentence served. Under the previous rules, progression would come after a quarter of the sentence served.

The benefits expected from the changes are not automatic, depending on whether the defenses request them from the Court. The rapporteur of the text in , deputy Paulinho da Força (-SP), stated that the lawyers of those arrested for the coup plot should call the STF so that the court can decide how the law applies to prisoners considered to have ordered the crimes.
