Stênio Garcia wins in court and should receive a monthly payment from his ex

The Rio de Janeiro Court of Justice granted a important victory for Stênio Garcia in the dispute against his daughters, Cássia and Gaya Piovesan, and his ex-wife, Clarice Piovesan, for the property in the Ipanema neighborhood, in the south zone of the city. According to the Court’s decision, the actor should receive R$5,000 monthly for using the apartment.

Stênio filed a lawsuit against his daughters in 2025, seeking to recover the apartment and receive compensation of R$200,000. The actor donated the property to his heiresses in 1992, when the two were still minors, but reserving its lifetime enjoyment to themselves.

“(The decision is) still a partial victory, since the judge only recognized Stênio’s undisputed 50%, and the other 50% that equally belongs to him, will still be discussed on the merits”, said Luiz Mantovani, the artist’s lawyer, to Estadão, also saying that the determination is “a watershed”. “Judge Maria Cristina Slaibe’s decision is in line with constitutional principles, a factor that we did not expect anything different from.”

Mantovani also commented on the media coverage of the case, saying that “The Brazilian press has also been playing a fundamental role in social oversight in this case, which certainly helps in a more careful procedural analysis that is in harmony with the republican values ​​that we all defend”.

Despite the favorable decision, Stênio and his legal team will continue with the process to regain full control of the property. “We will continue in the search for complete justice, which we will do together with Doctors Sérgio Figueiredo and Fabiano Lopes”, added Mantovani.

Cássia and Gaya’s legal team was contacted by Estadão, but, until the publication of this note, they did not respond. The space remains open.

Stênio and Clarice divorced in 1983. After the separation, Cássia and Gaya lived in the apartment for three years, with the mother occupying the property since 2019.

Since the beginning of the process, Stênio claimed to have been fired without assets from Globo and who lives on INSS retirement money. The actor also says that he was abandoned “affectively and materially” by his daughters, not receiving visits, calls or assistance with paying expenses and medications.

The amount requested by Stênio includes compensation for losses and damages, in addition to the costs of the process. The action also asks that the actor regain control of the property, even if it is necessary to use “police force”.
