The court in Prague shocked with the decision on Feri. He acquitted him in the case of rape, although he did not dispute the fact

Dominik Feri was acquitted in another case of alleged rape. The verdict is not yet final and the former deputy is serving a three-year sentence.

On Monday, the District Court for Prague 3 acquitted the Czech ambassador Dominik Feri of another rape charge. According to her, despite the disapproval of the then 17-year-old girl, Feri took off the condom during sex. According to the court, it is not rape, but the verdict is not final. Feri is already serving a three-year sentence for two rapes and one attempted rape. Next week, the court in Teplice should decide on his request for conditional release, TASR reporter writes based on the iDNES.cz server report.

The indictment proposed another 12 months for Feri unconditionally. But the court decided otherwise. According to the server, the verdict was justified by the fact that, from the point of view of fulfilling the facts of the crime, there was no rape, because Feri did not threaten violence or blackmail the victim. He did not dispute the act itself, but he does not agree with the classification as rape.

Police and the Constitutional Court

The police initially dismissed this case because they concluded that taking off a condom is not a crime. The woman agreed to sex, but only with a protected person. The Constitutional Court defended her and stated that expressing consent to a certain sexual activity does not exclude the criminal responsibility of the perpetrator, who then forces the victim to engage in another sexual activity. The police subsequently returned to the case.

In her earlier statement, the victim allegedly stated that Feri humiliated her, called her stupid in public and was happy about it. The woman is said to still have panic attacks and nightmares as a result of his act. The ex-member testified in the case on Monday, i.e. only after the statements of the injured party and witnesses. According to the state representative, in such a case, the victim’s statement is more easily challenged. Although she acknowledged that there are blank spaces in the woman’s statement, she attributed it to time, since the act allegedly happened in 2015. Feri’s defense attorney told the court to take into account the possibility that the woman made up the situation.

Conquest of justice

In November 2023, the court sentenced the former MP for TOP 09 to three years unconditionally for two rapes and one attempted rape. Feri entered prison in May 2024. His repeated attempts to get parole have so far been unsuccessful. The court will decide on his next request next week.
