The president of the Superior Electoral Court (TSE), Kassio Nunes Marques, will be the rapporteur of two actions related to the film Dark Horse and a third about the AtlasIntel research that mentioned audios from senator and presidential candidate Flávio Bolsonaro (PL-RJ) sent to banker Daniel Vorcaro.
The lawsuits discuss possible economic and political abuse linked to the financing and screening of the film about former president Jair Bolsonaro (PL) and alleged electoral targeting in electoral research.
In the action that questions the AtlasIntel survey, moved by the PL, the party maintains that the survey would have led the interviewees against Flávio Bolsonaro by reproducing, in one of the questionnaires, the audio of a conversation between him and Vorcaro, in which the parliamentarian asks for financial support for the film Dark Horse.
According to the party’s lawyers, eight of the 48 questions in the survey dealt with Flávio’s alleged involvement with Vorcaro, which would constitute a “clear inducement” of the electorate.
At the time, the survey showed that the son of former president Jair Bolsonaro fell six percentage points since April and appeared with 41.8% of voting intentions against 48.9% for President Luiz Inácio Lula da Silva (PT) in a possible presidential second round.
AtlasIntel stated that the audio test was administered exclusively after the respondent completed and fully submitted the main survey questionnaire.

In another action, Nunes Marques will report the request from deputy Rogério Correia (PT-MG) to block the screening of the film Dark Horse. The parliamentarian maintains that the production about Jair Bolsonaro could generate an “abusive electoral effect” during the presidential campaign.
According to the president, the request aims to “protect equality of chances, transparency of political financing, popular sovereignty and real freedom to vote”.
In the third process, the minister will be responsible for the action of deputy Arlindo Chinaglia (PT-SP), who calls for an investigation into possible abuses of economic and political power in financing the film. According to the parliamentarian, the production could influence the electoral scenario and unbalance the presidential dispute.
Newly sworn in as president of the Court, Nunes Marques published, at the end of May, a resolution that focused on him and ministers André Mendonça, vice-president, and Estela Aranha, analyzing actions on electoral propaganda during the presidential campaign.
It will be up to the trio to decide on requests from campaigns against advertisements from opponents and also analyze requests for the right to reply presented throughout the electoral dispute.
Appointed to the Federal Supreme Court (STF) by former president Jair Bolsonaro (PL) in October 2020, Kassio Nunes Marques was already predestined to command the TSE in 2026, since the presidency of the Court is defined by a rotation system between STF ministers.
