The president of the STF (Supreme Federal Court), ordered the CNJ (National Council of Justice) to create a working group to carry out a fine-tooth comb on those paid in the Judiciary. The ordinance was signed by the magistrate this Friday (5).
The working group will operate for 180 days and aims to offer “proposals for normative solutions” to the hanging problem. There are suggestions, for example, for an annual review of the judiciary ceiling.
Penduricalhos are compensation funds or aid used by members of the Judiciary to increase their salaries beyond the public service ceiling. The current salary limit is R$46,366.19 per month.
When justifying the creation of the Working Group, Fachin cites a scenario of instability regarding the issues. The president of the STF and the CNJ points to the absence of a general annual review as one of the factors that contribute to a “dispersion of administrative decision-making centers”.
According to Fachin, this “generated different realities, leading to a scenario of inequalities, legal uncertainty, lack of publicity and, most seriously, the use of conceptual subterfuges dissociated from reality.”
Since assuming the presidency of the STF, in September last year, Fachin has launched an offensive against the pendulicinhos. Minister Flávio Dino, rapporteur of an action against overpayment, has already prohibited the creation of new compensation amounts above the remuneration limit.
In March, a limit of hangings. According to the Court’s decision, compensation payments cannot exceed 70% of the magistrates’ salary.
The working group created by Fachin should actually be established next week. It is made up of five secretaries and judges from the CNJ, with guests from the CNMP (National Council of the Public Ministry), the DPU (Federal Public Defender’s Office), the Senate, the Chamber and the TCU (Federal Audit Court).
According to the ordinance, at the end of the work the group will present standards and proposals, including legislative ones. In other words, despite the popular appeal to put an end to penduricalhos, projects on the topic should only be presented after the elections and analyzed by the next wave of deputies and senators elected this year.
The penduricalhos map, however, will be ready within two months, according to the ordinance published by Fachin.
