Exit comes after the boy’s mother receives judicial pardon for manslaughter in her son’s death

“With the arrival of a new colleague in the defense, and faced with a legitimate incompatibility of defensive strategies, we decided, by mutual agreement, to end our work on the case”declared Florence Rosa.
The lawyer informed that there was a willingness to continue with the process and highlighted the importance of coherence in the conduct of the defense. “Disagreement regarding technical conduct is a natural circumstance in the practice of law, and strategic coherence is a prerequisite for the fullness of defense”he wrote.

HENRY BOREL CASE
According to the investigation, Monique and the former councilor Jairinho, having found the boy Henry, then 4 years old, lying on the floor of the room he shared with his mother, with cold feet and hands and rolled eyes.
Taken to Barra D’Or Hospital, in the west of Rio de Janeiro, the doctors who treated Henry stated that the boy arrived dead. The autopsy report showed injuries compatible with beating, internal bleeding and liver laceration caused by blunt action.
In the complaint of it was reported that Jairinho frequently attacked Henry, “imposing intense physical and mental suffering on her, while Monique failed to exercise her duty of protection and surveillance”.
CONVICTIONS
Jairinho was sentenced to 43 years, 9 months and 20 days in prison. The penalty covers double homicide, torture and coercion during the process.
Monique Medeiros obtained a judicial pardon for manslaughter. The jurors recognized that she committed an omission in the torture against Henry Borel, by not acting to prevent the attacks suffered by her son. The established sentence was 1 year and 4 months of detention, extinguished with the granting of a judicial pardon.
The boy’s father, Leniel Borel, filed an appeal on Monday (June 8). which granted judicial pardon to the child’s mother. The defense argues that “the jurors had already recognized the materiality and authorship attributed to Monique, as well as rejecting the acquittal thesis presented by the defense”.
