ERC suspends infringement proceedings against LiveModeTV

The decision comes after the company has advanced with the registration required by the ERC, without giving up the challenge to the classification of its service.

The ERC suspended the initiation of the infringement procedure LiveModeTV until the process is reviewed by the Regulatory Council, after the platform registered this Tuesday, an official source from the regulator told Lusa.

Contacted by Lusa, official source of Regulatory Entity for Social Communication (ERC) clarified “that the infringement procedure is suspended until the process is reviewed by the Regulatory Council”.

According to the same source, LiveModeTV registered with the ERC as an on-demand audiovisual service on Tuesday.

On Monday, the ERC Regulatory Council decided to open administrative proceedings against LiveMode for failing to present, within 72 hours, the elements legally required by the entity.

On the same day, the platform, which broadcasts the 2026 World Cup games in Portugal, announced that it had requested registration with the ERC as an on-demand audiovisual service, as required by the regulator, although it maintains the position that this classification does not correspond to its activity model.

“LiveModeTV will now present to the ERC detailed documentation on the current model of its project, demonstrating that its activity does not fall into the category of on-demand audiovisual service. The company is confident that, as happened with the classification as a web television service, the analysis of these elements will lead the ERC to conclude that LiveModeTV does not fall into this category,” the company said.

LiveModeTV Portugal is owned by the company LiveMode Portugal, Unipessoal, Lda.

In Portugal, the project stands out for broadcasting 34 World Cup games live, one per day, including National Team games, free of charge, with the activity beginning around six months ago, coinciding with the first video made available on the YouTube platform.
