Domestic equipment that uses substances with potential environmental impact are subject to strict legal norms. Among them are Split-type air conditioning systems, which contain greenhouse fluoride gases and whose sale and installation obey rules defined by European and Portuguese legislation.
Commercialization and installation
It determines that non -hermetically sealed equipment that includes fluoride gases, such as split, can only be sold to the end consumer by proof that the installation will be performed by a certified company.
Similarly, Article 13 (6) of Decree-Law No. 145/2017 establishes that the installation of these devices can only be done by companies with valid certification, without prejudice to the need for certification of the technicians who perform the work.
Compulsory records
Companies selling equipment with fluoridated gases should conserve, for a minimum period of five years, information on sales made and the company responsible for the installation. This obligation, provided for in Regulation (EU) 2024/573, aims to allow control by the competent authorities whenever necessary.
In Portugal, article 7 of Decree-Law No. 145/2017 specifies that the registrations must include the name and tax identification number of the installation company, the number of the respective certificate, as well as the brand, model and serial number of the equipment sold.
Offenses and sanctions
Failure to default these provisions may configure an environmental offense, pursuant to Law No. 50/2006.
Fines vary according to gravity and degree of guilt, and may, in cases considered very serious, be aggravated to double when involving dangerous substances with significant impact on the environment.
Recommended Good Practices
To avoid legal problems, it is advisable to resort only to certified companies and technicians, maintain all purchase and installation documentation for at least five years and respect any municipal rules related to noise, neighborhood and placement of foreign units.
In horizontal property buildings, the condominium authorization should also be obtained if the installation of the outer units alters the appearance or architectural line of the facade.

These standards are part of European effort to reduce greenhouse gas emissions from fluoride gas, reinforcing control and promoting responsible practices in the climate sector.
