The parties claim that the profile uses deep fake technologies to advance and disseminate fake news in the context of the pre-campaign for 2026.
The representation was filed with the TSE (Superior Electoral Court) on Wednesday (22) and distributed by draw to the rapporteur of minister Estela Aranha, who will be responsible for handling the case.
The parties mention in the document that the “Dona Maria” profile presents a fictitious black elderly woman, accumulating a large digital reach, with more than 700 thousand followers and 413 publications on Instagram alone.
The PT and allies in the process maintain that the character is an anonymous artificial creation aimed at attacking the president and ministers of the (Federal Supreme Court), such as . They also highlight that such publications decontextualize central themes on the public agenda, potentially damaging the balance of the election.
One of the central points of the request cites a post that questions the integrity of the 2022 electoral process, suggesting undue interference in the results of the polls. For the authors, this practice constitutes the crime of disclosing facts known to be untrue, typified by article 323 of the Electoral Code.
The federation requests the removal of the profile, stating that content created by artificial intelligence without proper identification of authorship on social networks violates transparency standards and serves as a shield for the commission of electoral crimes.
It also points to the existence of a business model behind the use of AI in political advertising. According to the representation, the “Dona Maria” profile replicates this logic through short, controversial videos distributed en masse, which would characterize negative propaganda.
The creator of the profile is Daniel Cristiano dos Santos, resident of MagĂ© (RJ) and app driver. He said that he works alone, earns “little” from profiles and that he refused advertising invitations.
