Chamber approves urgency to analyze Mounjaro patent breach PL

Now, the text can be analyzed in Plenary in another vote without needing to be processed by House committees

The Chamber of Deputies approved this Monday (9) the urgent regime to consider the bill that provides for the breaking of the patent for the medicines Mounjaro and Zepbound. With the decision, the text can be analyzed directly in plenary in another vote, without the need to go through thematic committees.

Patent infringement allows the government to authorize other laboratories to produce a medicine without the consent of the original patent holder. The measure aims to increase the availability of medicines and facilitate their incorporation into the Unified Health System (SUS).

The urgency request was presented by federal deputy Mário Heringer (PDT-MG) and approved by 337 votes in favor and 19 against. A doctor by training, the parliamentarian stated that the adoption of the medicine by the public system could generate savings of around R$70 billion for the public coffers.

“There are a series of diseases that can be treated with this type of medicine. The resources spent to treat these illnesses tend to exceed the amount spent on acquiring the medicine. With the breaking of the patent, access will no longer be restricted to the most advantaged people, as is the case today”, argued the deputy.

The Novo Party bench advised a vote against the urgency. According to deputy Adriana Ventura (Novo-SP), the proposal could generate legal uncertainty and discourage investments in innovation in Brazil.

“The patent has a fundamental role: guaranteeing investment. This is the case all over the world. With this measure, other investments can be discouraged. The discussion is legitimate, but, at the very least, we should hold a series of debates and hearings. This topic needs to be further explored”, said Adriana.
