Minister André Mendonça orders Alcolumbre to deliver Vorcaro data to the INSS CPMI

The Minister of the Federal Supreme Court (STF) André Mendonça authorized that data from banker Daniel Vorcaro obtained through breaches of confidentiality be returned to the INSS Joint Parliamentary Commission of Inquiry (CPMI) and shared with the Federal Police (PF). At the request of the CPMI, he reconsidered the decision made by Minister Dias Toffoli – former rapporteur of the case – who determined that the information obtained through Vorcaro’s breach of confidentiality would be kept by the president of the Senate, Davi Alcolumbre (União-AP).

“The investigation of fraud to the detriment of the social security system involves a primary public interest, related to the protection of public assets, as well as the defense of a vulnerable portion of the population,” stated the minister in the decision.

The minister also considered that the delivery of information to the PF and the return of data obtained from the INSS CPMI initiative are “adequate, necessary and proportionate measures to ensure the continuity of investigations and the full achievement of the constitutional purpose of the CPIs”.

Mendonça also determined that the use of this information “strictly observes fundamental guarantees, including the preservation of privacy and the chain of custody of the evidence”.
