The minister of the (Supreme Federal Court) revoked a decision of the Labor Court that dealt with an employment relationship in a franchise contract. He ordered the suspension of the process.

This time, Nunes Marques accepted Prudential’s request. The insurance company questioned the ruling of the TST (Superior Labor Court) that had continued the process of a broker, who claims to have an employment relationship with the company.
In the decision, the minister said that the court “maintained the regular processing of the files, in clear non-compliance with the decision handed down by this Supreme Court”.
It is not the first time that Nunes Marques has overturned a Labor Court decision. He had already done the same with another TST ruling and eight regional decisions.
The pejotization is ready to be judged by the STF. The process that will be analyzed by the ministers discusses the validity of contracts, the competence of the Labor Court and the definition of who should bear the burden of proof: the worker or the contractor.
