The State Court of Paraná accepted the request from CBV (Brazilian Volleyball Confederation) and determined in an injunction that the municipality of Londrina not prevent the Copa Brasil Feminina, scheduled to take place in the city this Friday (27) and Saturday (28).
A Sheet contacted the city hall’s press office, but has not yet received a response. CBV also contacted the STF (Supreme Federal Court) and the case is being reported by Minister Cármen Lúcia.
A request approved this Thursday (26) by the Chamber of Londrina asked the city hall to act to prevent the participation of player Tifanny Abreu, a trans woman who plays for Osasco Voleibol Clube, from participating in the World Cup.
The request is based on a 2024 municipal law that prohibits the “participation of athletes identified contrary to their biological sex at birth in sports teams and teams and in competitions, events and disputes in sports” in Londrina.
The request had 12 votes in favor and four against and was proposed by councilor Jessicão (PP), known in the city for defending Bolsonarist flags.
In his decision, judge Marcus Renato Nogueira Garcia states that “on a purely formal level, the norm [lei municipal 13.770, de 2024] appears to violate the competence of the Union, the States and the Federal District to legislate concurrently on sports matters”.
“In the material sphere, the unconstitutionality appears even clearer, contravening the foundations and objectives of the Republic expressly provided for in the Federal Constitution”, continues the judge, citing that municipal law reduces the status of freedom and dignity of trans people.
When defending his request during the Chamber session, Jessicão said that the majority of the population in the city was conservative and that “we are only discussing compliance with the law”.
“And what does the law say? Born a man will compete with a man, born a woman will compete with a woman. We are not voting against the event. It is a request asking the mayor to fulfill his part of not letting Tifanny play. Not letting Osasco play if she is scheduled. That’s all,” she stated.
Councilor Paula Vicente (PT), who protested against the request, said that she has been trying measures with the Public Ministry and Public Defender’s Office so that the 2024 law is definitively overturned.
