The Great Debate: Limiting plea bargaining: Necessity or exaggeration?

Commentator José Eduardo Cardozo and journalist and former senator Ana Amélia Lemos debated, this Friday (10), in The Great Debate (from Monday to Friday, at 11 pm), the measure of the minister of the STF (Supreme Federal Court), Alexandre de Moraes, who released for trial in the Court’s plenary an action by the PT (Workers’ Party) that could restrict award-winning collaborations.

For Ana Amélia Lemos, Moraes’ decision is inappropriate and untimely, creating more doubts about her performance.

“Trying to limit the action of the nominee’s plea bargain, in the circumstance that it was proposed by the PT, was in reaction to Lava Jato. Therefore, it had to do with the performance of judges”, he stated.

She also highlighted that this change in criteria could create distrust in the work that the Federal Police has been carrying out with competence and rigor in investigations related to Banco Master.

Cardozo acknowledged that the text was very open and that there were abuses, especially in Lava Jato.

“It was a show of abusiveness, with accusations in which people were put in prison and it was said, either you say what I want, or you will be arrested”, he explained.

Cardozo defended the need to establish parameters to regulate the good application of the plea bargaining institute in accordance with fundamental rights.

However, he highlighted that the problem lies at the moment the discussion is brought to light:

“I don’t know what Minister Alexandre de Moraes’ vote is. What if he voted for the inadmissibility of the action? I’m already assuming that his vote is to limit it and that he will limit it for his benefit,” said Cardozo.

Federal Police investigators expressed concern about the timing of the action, as Daniel Vorcaro’s possible plea bargain has not yet been agreed upon.

The timing of the discussion raises questions about possible interference in ongoing investigations related to the Banco Master case, which involves authorities from the three branches of government.
