Deputy Pedro Uczai files proposal that revokes legal framework for sports betting and online gaming in Brazil

WHAT THE PROJECT PREDICTS
The project wants to ban all activities related to fixed-odd betting, including platform operation, dissemination, advertising, intermediation and processing of financial transactions. The measure applies to physical and digital environments and includes companies based abroad that work with the Brazilian public.
The ban affects individuals and legal entities, as well as digital platforms, social networks, search engines, applications, hosting services, financial institutions and fintechs. The text also prohibits advertising, sports sponsorship, influencer marketing, affiliation programs, promotional bonuses, free bets, promotional codes and other forms of commercial communication linked to betting.
In justification, Uczai states that the measure seeks to protect the population in the social, health and economic fields. “The protection of Brazilian society, the popular economy and the material dignity of families requires the prohibition of betting in Brazil”, these.
According to the deputy, recent experience shows that betting is no longer presented as digital entertainment and has started to act as a mechanism for capturing popular income. He cites an increase in family debt, impacts on retail, pressure on the SUS (Unified Health System) and diversion of consumption resources to digital platforms.
The project determines that Anatel (National Telecommunications Agency), in conjunction with the federal authority designated by the government, adopt measures to prevent the operation of websites, applications and services linked to prohibited betting. Actions include blocking domains, URLs, IPs and DNS, removing applications from digital stores, deindexing in search engines and interrupting hosting and monetization.
REGULATION IN THE FINANCIAL SECTOR
In the financial sector, banks and payment companies must block, refuse or interrupt transactions related to betting. The text projects regulation by the Central Bank and the reporting of suspicious transactions to the Financial Activities Control Council.
Platforms with more than 1 million users in Brazil must create reporting channels, remove content promoting illegal betting and publish monthly transparency reports.
The project establishes administrative sanctions such as warnings, fines of R$50,000 to R$2 billion, suspension of activities, revocation of licenses and prohibition of contracting with public authorities.
The proposal also creates crimes for the exploitation of betting platforms, paid promotion, financial intermediation and offering mechanisms to circumvent blocks. Penalties range from 2 to 8 years in prison, in addition to a fine, with aggravating circumstances in cases involving vulnerable people, large-scale influencers or criminal organizations.
The text guarantees the free circulation of journalistic, scientific, academic, health and educational content on the impacts of betting, as long as it does not constitute commercial advertising.
The report contacted the (Brazilian Institute of Responsible Gaming) to ask if it would like to comment on the project that proposes a ban on fixed-odds betting in Brazil. The organization did not issue a statement until the publication of this text.

The regulation of the sector was structured by the federal government with the aim of bringing an activity that already occurred in an unregulated manner into a controlled environment. The model establishes supervision, transparency and consumer protection mechanisms that are not present in the illegal market.
In this context, any measures that weaken the regulated environment do not eliminate the activity, but may encourage its migration to unauthorized platforms, where there is less capacity for monitoring and user protection. Strengthening regulation and monitoring instruments is the most appropriate way to mitigate risks, including those associated with compulsive behavior, in addition to expanding consumer protection.
