Fachin repudiates the inclusion of ministers in the CPI on Organized Crime report

The text presented by the rapporteur called for the indictment of Alexandre de Moraes, Dias Toffoli and Gilmar Mendes

Edson Fachin stated that deviations from the purpose of the CPIs ‘weaken the democratic pillars’

The president of the Federal Supreme Court (STF), Edson Fachin, repudiated this Tuesday (14) the final report of the Parliamentary Commission of Inquiry (CPI) into Organized Crime which called for the indictment of ministers Alexandre de Moraes, Dias Toffoli and Gilmar Mendes. The judge expressed solidarity with his colleagues at the Court.

In a note, Fachin stated that the ministers were “improperly mentioned in the final report”. The president of the STF said he recognized the “fundamental guarantee” for the exercise of CPIsas long as, “within constitutional limits” and “circumscribed to the thematic relevance that gave rise to its creation”.

“Deviations from the thematic purpose of these commissions, however, weaken democratic pillars and threaten the fundamental rights of any citizen”, declared Fachin.

The judge reaffirmed that the STF “will remain firm in its mission of guarding the Constitution e protect democratic freedoms”.

Final report rejected

The Organized Crime CPI rejected this Tuesday the final report presented by senator Alessandro Vieira (MDB-SE). There were six votes against and four in favor.

The rejection of the report came after the head of the Executive, Luiz Inácio Lula da Silva (PT), and the president of the Senate, Davi Alcolumbre (União Brasil-AP). The articulation resulted in the exchange of senators Sergio Moro (PL-PR) and Marcos do Val (Avante) by Teresa Leitão (PT-PE) and Beto Faro (PT-PA). The CPI was formed by 11 sitting parliamentarians, of whom ten voted, and seven substitutes.

Organized Crime CPI

Installed on November 4, 2025, the CPI investigated the activities, expansion and functioning of criminal organizations in Brazilian territory, especially factions and militias. The collegiate investigated the modus operandi, operations in each region and their structures in order to identify suitable solutions to combat, mainly through improvement of current legislation.
