The absence of effective control mechanisms over the ministers of the STF (Supreme Federal Court) is a serious problem that compromises the credibility of the entire Brazilian judicial system.
The assessment was made by lawyer Ligia Maura Costa, professor at FGV-Easp (São Paulo School of Business Administration at Fundação Getulio Vargas), during participation in the program WW Special: What judicial reform does Brazil need?which airs this Sunday (3), at 10pm (Brasília time).
Ligia Maura Costa pointed out that neither Loman (Organic Law of the National Judiciary), nor the CNJ (National Council of Justice), apply to STF ministers. “Who controls the top of the Judiciary system?” he asked.
The professor praised the proposal by the president of the STF, Edson Fachin, to create a code of ethical conduct for members of the Court. She recalled that the United States adopted a similar measure in 2023, after facing problems of conflict of interests among its ministers.
Ligia Maura Costa also cited Germany as a positive reference. In the German model, there are limited mandates for ministers. “Afterwards, they will become lawyers again,” he explained.
