Court says there is no evidence of use of public funds; states that analysis is up to the Electoral Court in campaign accounts
The TCU (Federal Audit Court) archived the representation that requested an investigation into what was linked to the businessman by the deputy (PL-MG) during the 2022 electoral campaign and ordered the case to be sent to the Electoral Court.
The decision was formalized in a ruling reported by minister Antonio Anastasia, who pointed out the absence of evidence of use of public resources by Nikolas Ferreira.
The TCU decided, in a ruling signed on April 25, 2026, that the facts involve campaign financing, the analysis of which is the responsibility of the Electoral Court, and not the Court of Auditors.
The representation had been presented by the Public Ministry to the TCU and questioned the origin of the resources used in air travel carried out in the second round of the 2022 elections. The request sought to investigate any use of public resources or omission of electoral expenses.
When analyzing the case, the court stated that there is no “minimum evidentiary basis” that justifies the opening of an investigation in the Court. He also highlighted that the technical-accounting investigation of campaign expenses and the judgment of electoral accounts are responsibilities of the Electoral Court.
With the archiving, the process was forwarded to the TSE (Superior Electoral Court) and the Public Electoral Ministry, which can continue the analysis from the perspective of electoral financing rules.
UNDERSTAND
The trips took place in the second round of 2022, when the deputy participated in agendas in support of then-president Jair Bolsonaro. The group traveled to at least nine states and the Federal District in a political caravan, using an aircraft associated with the company of which Vorcaro was a partner.
The case gained visibility after , of which Vorcaro is the owner. The banker is imprisoned in the Papuda penitentiary complex.
At the time, the deputy stated that he had no knowledge of the owner of the aircraft and that he participated in the trips at the invitation of the agenda organizers.
The decision limits the TCU’s actions in cases related to electoral expenses and reinforces that monitoring campaign financing is the responsibility of the Electoral Court. In practice, the understanding reduces overlap between control bodies and defines the appropriate forum for investigating possible irregularities.
